ATV West Virginia Marketplace Rules

The Marketplace is provided as a place for community members to buy and sell ATV- and UTV-related items. These rules are intended to keep listings useful, honest, and safer for everyone.

By posting or responding to a Marketplace listing, you agree to follow these rules and the general ATV West Virginia Community Rules.

1. Permitted Listings

Marketplace listings should be directly related to ATV and UTV riding, including:

• ATVs and UTVs
• Parts and accessories
• Trailers
• Helmets and riding gear
• Recovery equipment, tools, and trail-related equipment

Unrelated merchandise, illegal items, stolen property, firearms, ammunition, controlled substances, counterfeit goods, and items the seller is not legally permitted to sell are prohibited.

2. Provide an Accurate Description

Every listing should include:

• A clear title
• Make, model, and year when applicable
• Asking price
• General location
• Current condition
• Known damage, mechanical problems, or missing parts
• Mileage or operating hours when applicable
• Current photographs of the actual item

Do not conceal known problems, use misleading descriptions, or post photographs of a different item.

3. Ownership, Titles, and Liens

Only list items that you own or are authorized to sell.

Clearly disclose title status, existing liens, rebuilt or salvage history, and any ownership documentation issues. Buyers should independently verify the vehicle identification number, title, lien status, and seller’s identity before exchanging money.

Listings for suspected stolen property will be removed and may be reported to the appropriate authorities.

4. Prices and Listing Conduct

Include an asking price unless the item is genuinely being offered for trade.

Do not create duplicate listings, repeatedly repost the same item, manipulate replies to keep a listing at the top, or interfere with another member’s sale. Mark the listing as sold or ask a moderator to close it when the item is no longer available.

Price disagreements are not a reason to attack a seller. If you are not interested in purchasing an item, move on without disrupting the listing.

5. Businesses and Dealers

Businesses, dealers, rental companies, and professional sellers must clearly identify their business connection.

Commercial advertising must follow ATV West Virginia’s business-promotion and advertising policies. Do not flood the Marketplace with inventory or use personal-looking listings to avoid advertising requirements.

6. Transactions Are Between Members

ATV West Virginia does not inspect items, verify sellers, process payments, hold deposits, provide warranties, guarantee listings, or resolve transaction disputes.

All purchases, sales, trades, shipping arrangements, deposits, and payments are strictly between the buyer and seller. Each party is responsible for performing appropriate research and deciding whether to proceed.

7. Protect Yourself From Scams

Use caution before sending money or sharing personal information.

Whenever possible:

• Inspect the item in person
• Meet in a safe public location
• Verify identification, ownership, VIN, and title information
• Use a payment method that provides appropriate documentation
• Be cautious of gift cards, cryptocurrency demands, wire transfers, overpayment schemes, shipping agents, and requests to communicate outside the forum immediately

If an offer appears unusually urgent or too good to be true, stop and verify it before proceeding.

8. Protect Personal Information

Post only a general location in the public listing. Do not publicly share your home address, financial information, driver’s license, title documents, or other sensitive personal information.

Use private communication carefully when arranging an inspection or transaction, and only share information necessary to complete the sale safely.

9. Report Suspicious Listings

Report listings that appear fraudulent, misleading, stolen, unsafe, prohibited, or in violation of these rules. Do not publicly accuse or confront another member; allow the moderators to review the situation.

10. Moderation and Removal

ATV West Virginia may edit, close, move, or remove any listing that violates these rules, presents a safety concern, appears fraudulent, or is not appropriate for the Marketplace.

Repeated or serious violations may result in Marketplace restrictions, account suspension, or permanent removal from the community.

ATV West Virginia provides the Marketplace only as a community discussion and listing area. ATV West Virginia is not a party to any transaction and makes no representations or warranties concerning any listing, seller, buyer, item, payment, title, or transaction.

Buyers and sellers assume all responsibility and risk associated with Marketplace activity.
